Hemp Wellness Products Are in Danger in Texas

Senate Bill 3 threatens Texas access to CBD products, but you can help amend it

I would like to voice my extreme concern for the passage of SB 3. Natural hemp products, which contain CBD and Delta-9-THC, are critical for my daily health and wellness routine. The proposed THC ban in the bill will remove the people of Texas's access to non-intoxicating full-spectrum hemp products. By doing so, the State of Texas is taking a step backwards on the immense progress it’s made with the cannabis plant.

Non-intoxicating hemp products, and all of their constituents, are an expression of the true essence of the plant, leading to what many refer to as the “Entourage Effect.” When removing THC from hemp extracts, many other cannabinoids are unavoidably removed. In turn, the efficacy or benefits of these products are severely reduced and ultimately detrimental to my daily wellness routine.

SB 3 will destroy my access to this amazing medicine and all the naturally beneficial compounds it has to offer. Please take this note into consideration and vote against SB 3, or amend it such that reasonable, science-based THC limits are instituted. After all, the purpose of the bill should be to eliminate the bad actors selling products intended to intoxicate the consumer, while also preserving our citizens’ access to proven, effective, natural remedies like non-intoxicating full-spectrum non-intoxicating hemp products.

What is SB 3?

The State of Texas is actively working on a bill, known as SB 3, which seeks to restrict the purchase of ingestible hemp-derived products containing any amount of THC.

Why are They Doing This?

The sponsor of SB 3 has openly admitted that legislators are aiming to ban ingestible products containing THC because they don’t understand the basic science behind cannabinoids. We believe that this willful lack of understanding will have a significant and meaningful negative impact on the health and wellbeing of millions of Texans.

What Does This Mean for Me?

We know that our customers enjoy our products for a variety of reasons, all of which are geared towards fulfilling a healthy and balanced lifestyle. Right now, we need your support more than ever.

If this bill passes in its current state, it will eliminate our ability to ship only products containing THC – inclusive of all our non-intoxicating CBD products – to our customers in Texas.

Why Are States Restricting Federally Legal CBD?

Many customers ask us why hemp-based products containing up to 0.3% THC are federally legal yet so many states, potentially including Texas, have imposed severe and often illogical restrictions on products. This happens because of a few issues:

  • The federal government has failed to create any sort of regulatory structure for the industry other than the 0.3% THC cap.
  • As a result, there are many synthetic products on the market, some of which aren’t even found in the cannabis plant. These are products manufactured chemically, solely for their intoxicating potential. Some synthetic versions are significantly more potent than naturally occurring, hemp-derived Delta-9 THC. These were not considered or intended at the time the 2018 Farm Bill was passed, and they carry with them legitimate concerns about how they’re made and whether they are safe for consumption. These products often contain many unidentified chemical byproducts introduced during manufacturing.
  • The worst of the bad actors have deliberately designed intoxicating hemp products that visually mimic candies or popular snacks, and market them to minors.
  • Companies aren’t using child-resistant packaging for intoxicating hemp products.
  • The lack of any enforcement across the country has led to a landscape that can only be described as the Wild West. The bad actors across the CBD industry have not felt any consequences for their business practices and have been emboldened to take more and more risks. This environment severely hurts responsible companies like CBDistillery as we proudly have costs associated with product safety, testing and compliance.

I am happy to say that the CBDistillery brand has always taken a responsible approach to hemp-derived Delta-9 THC, with non-intoxicating amounts of delta-9 THC and only using naturally derived cannabinoids. Our focus has been and always will be on providing you with the most rigorously tested, cGMP-compliant, safe, and efficacious products. We will never cut corners for a buck because earning your business and trust is too important to us.
